1. Acceptance of Terms

Welcome to EarnScreen! By downloading, installing, or using the EarnScreen mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and EarnScreen ("we," "us," or "our").

2. Description of Service

EarnScreen is a productivity and screen time management application that:

• Allows you to block distracting apps and websites on your iOS device
• Provides quests and challenges to earn "Brain Credits"
• Enables temporary unlocking of blocked apps using earned credits
• Offers premium features through subscription plans
• Operates entirely on your device with optional cloud sync for Parent-Child mode

The App is designed to help you develop healthier screen time habits through positive reinforcement and gamification.

3. Eligibility

You must be at least 13 years old to use EarnScreen. By using the App, you represent and warrant that:

• You are at least 13 years of age
• If you are between 13 and 18, you have obtained parental or guardian consent
• You have the legal capacity to enter into these Terms
• You will use the App in compliance with all applicable laws and regulations

Parent-Child Mode

If you are a parent or guardian setting up EarnScreen for a child under 18, you are responsible for monitoring their use and agree to these Terms on their behalf.

4. License & Restrictions

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on devices you own or control.

Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, reproduce, distribute, or create derivative works from the App
• Use the App for any unlawful, harmful, or fraudulent purpose
• Attempt to circumvent, disable, or interfere with security features
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use automated tools (bots, scripts) to manipulate quest completion or credits
• Exploit bugs, glitches, or unintended features for unfair advantage
• Share your subscription access with others (except Parent-Child mode)
• Sell, rent, lease, or sublicense the App to third parties

5. User Accounts & Data

No Account Required

EarnScreen does not require creating an account. All data is stored locally on your device.

Parent-Child Mode (Optional)

If you enable Parent-Child mode:

• Limited data (quest completion counts and credit balances) syncs via your iCloud account
• You are responsible for securing your Apple ID and devices
• We cannot recover lost data if you lose access to your iCloud account
• You can disable this feature at any time in settings

Your Responsibility

You are responsible for:

• Maintaining the security of your device
• All activity that occurs through your installation of the App
• Backing up your device data (if desired)

6. Subscriptions & Payments

Free Trial

EarnScreen offers a 7-day free trial with full access to all premium features. You can cancel anytime during the trial without being charged.

Subscription Plans

After the free trial, you may choose from the following subscription options:

• Monthly: $1.99/month, billed monthly
• Yearly: $9.99/year, billed annually (saves 58%)
• Lifetime: $19.99 one-time payment for lifetime access

Billing & Renewal

• All subscriptions are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple account will be charged within 24 hours prior to the end of the current period
• You can manage or cancel your subscription in your Apple ID settings

Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect existing subscriptions until renewal. You will be notified of any price changes in advance.

Refund Policy

All purchases are handled by Apple. Refunds are subject to Apple's refund policies. To request a refund, contact Apple Support directly. We do not have the ability to issue refunds.

Free Features

Without a subscription, you can:

• Unlock apps once per day for 15 minutes
• Complete all quests to earn credits
• Use basic app blocking features
• Access the Brain Credits meter

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to:

• Text, graphics, logos, icons, images, and audio
• Software code, algorithms, and user interface design
• Compilation, organization, and presentation of content
• "EarnScreen" name, branding, and trademarks

...are the exclusive property of EarnScreen and are protected by copyright, trademark, and other intellectual property laws.

Apple, iOS, iPhone, iPad, iCloud, App Store, FamilyControls, ManagedSettings, DeviceActivity, and CoreMotion are trademarks of Apple Inc.

8. Privacy & Data

Your privacy is critically important to us. Please review our Privacy Policy to understand how we handle information.

Key Points:

• We do not collect, store, or transmit your personal data
• All quest data, credits, and settings are stored locally on your device
• Motion sensor data is processed on-device and never transmitted
• We do not use analytics, tracking, or advertising tools

9. App Permissions

EarnScreen requires the following iOS permissions to function:

Screen Time (Family Controls)

Required: Yes
Purpose: To block and unblock apps based on your Brain Credits
Can be revoked: Yes, but the app will not function without it

Motion & Fitness

Required: No (only for walking/running quests)
Purpose: To verify physical activity during quests
Can be revoked: Yes, but motion-based quests will be unavailable

Notifications

Required: No
Purpose: To remind you about quests and app re-blocking
Can be revoked: Yes, at any time in iOS Settings

10. Prohibited Conduct

You agree not to engage in any of the following:

• Using the App to harm, harass, or violate the rights of others
• Attempting to gain unauthorized access to the App or its systems
• Introducing viruses, malware, or harmful code
• Interfering with the proper functioning of the App
• Using the App in any way that violates local, state, or federal laws
• Falsely claiming credits by manipulating motion sensors or timers
• Sharing methods to exploit bugs or bypass intended functionality

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be error-free, secure, or uninterrupted
• Warranties regarding the accuracy, reliability, or completeness of content

WE DO NOT GUARANTEE THAT:

• The App will meet your specific requirements
• The App will always be available or accessible
• Defects will be corrected
• The App is free from viruses or harmful components

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNSCREEN SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from your use or inability to use the App
• Damages caused by errors, bugs, or interruptions in the App
• Damages from unauthorized access to your device or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM (OR $50 USD, WHICHEVER IS GREATER).

Some jurisdictions do not allow the exclusion of certain warranties or liability limitations, so the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless EarnScreen and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Any content or data you provide through the App (e.g., in Parent-Child mode)

14. Medical & Health Disclaimer

EarnScreen is NOT a medical device or health application.

The App's quests (walking, running, stretching, etc.) are for motivational and entertainment purposes only. They are not intended to:

• Diagnose, treat, cure, or prevent any disease or condition
• Replace professional medical advice or treatment
• Provide accurate health or fitness tracking

Consult a physician before starting any exercise program. If you experience pain, discomfort, or unusual symptoms during any quest, stop immediately and seek medical attention.

15. Parental Responsibility

If you are a parent or guardian using EarnScreen to manage a child's screen time:

• You are solely responsible for monitoring your child's use of the App
• The App is a tool to assist parenting, not a substitute for active supervision
• We are not liable for any consequences of how you choose to use the App with your child
• It is your responsibility to determine appropriate screen time limits for your child

16. Third-Party Services

EarnScreen relies on Apple's iOS frameworks (FamilyControls, ManagedSettings, DeviceActivity, CoreMotion) to function. These services are governed by Apple's terms and policies.

We are not responsible for:

• Changes to iOS or Apple frameworks that affect the App
• Apple's decisions regarding app blocking or Screen Time permissions
• Issues caused by iOS updates or device compatibility

17. Updates & Modifications

App Updates

We may release updates to improve functionality, fix bugs, or add features. Updates may:

• Be required to continue using the App
• Change features or remove functionality
• Occur automatically if you have auto-updates enabled

Terms Updates

We reserve the right to modify these Terms at any time. When we do:

• We will update the "Last Updated" date
• Material changes will be communicated through the App or website
• Continued use after changes constitutes acceptance

If you do not agree to updated Terms, you must stop using the App and may request a refund (subject to Apple's policies).

18. Termination

By You

You may stop using the App at any time by:

• Deleting the App from your device
• Canceling your subscription (if applicable)

By Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse, misuse, or exploitation of the App
• Any other reason at our sole discretion

Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must delete the App from all devices
• Sections of these Terms that should survive (e.g., disclaimers, limitations) remain in effect
• You are not entitled to a refund unless required by law

19. Dispute Resolution

Informal Resolution

Before filing a claim, please contact us at info@eqmo.com to attempt an informal resolution. We'll work with you in good faith to resolve disputes.

Governing Law

These Terms are governed by the laws of [Your Jurisdiction] without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial or to participate in a class action lawsuit.

Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EarnScreen regarding the App and supersede all prior agreements or understandings.

22. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

23. Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or successor without restriction.

25. Apple-Specific Terms

Because EarnScreen is distributed through the Apple App Store, the following terms apply:

Acknowledgment

• These Terms are between you and EarnScreen, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for the App or its content

Scope of License

The license granted is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by Apple's Usage Rules.

Maintenance & Support

EarnScreen is solely responsible for providing maintenance and support. Apple has no support obligations.

Warranty

To the extent permitted by law, Apple has no warranty obligations. Any claims, losses, or damages fall under these Terms, not Apple's responsibility.

Product Claims

EarnScreen is responsible for addressing any claims relating to:

• Product liability
• Failure to conform to legal or regulatory requirements
• Consumer protection or similar laws

Intellectual Property

In the event of a third-party claim that the App infringes intellectual property rights, EarnScreen (not Apple) is responsible for investigation and defense.

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.
